Framingham State University is committed to fostering a safe and inclusive environment, especially when it comes to matters of sexual harassment and misconduct. In line with Title IX, the university's Sexual Harassment Policy outlines several barriers to consent that students and faculty should be aware of.

One of the primary barriers to consent is incapacitation, which refers to a lack of the ability to make informed, rational judgments due to factors such as alcohol or drugs. This is a crucial factor as consent cannot be given if an individual is incapacitated or unable to fully comprehend the situation.

Another barrier is coercion, or unreasonable, continued pressure for sexual activity beyond the point of refusal. Such behaviour is considered sexual misconduct.

Age is another significant factor. Minors cannot legally consent to sexual relationships, and anyone over 16 cannot engage in a sexual relationship with someone under 16, as per Ohio law.

The university's policy also acknowledges situations where an individual cannot freely give consent due to power dynamics or intimidation as barriers to consent.

In light of these barriers, it's essential to promote awareness and understanding of consent. Framingham State University offers a Consent Essentials workshop aimed at educating students, providing them with skills and vocabulary for consent practices.

It's important to note that the use of physical violence to gain sexual access is not acceptable, and threats or coercion to engage in sexual activity are also considered sexual misconduct.

Faculty and staff members are also bound by these rules. Engaging in a sexual relationship with a student or assuming or presuming previous consent for future sexual interactions are behaviours that will result in consequences.
