Texas Governor Abbott Imposes Age Restrictions on THC Products
Texas Governor Greg Abbott has issued an executive order, leading to immediate age restrictions on THC products. The state health agency has approved an emergency rule banning sales to under-21s, effective immediately. The Texas Alcoholic Beverage Commission (TABC) has also adopted similar emergency rules, set to last up to 180 days. Industry representatives largely welcome the move, expecting the age limit to be 21.
The emergency rules require hemp license holders to verify customers' ages using valid ID. Violations may result in license or registration revocation. Greg Abbott's order follows the Texas Legislature's inability to reach a compromise on THC regulation during two special sessions. The formal rulemaking process is set to begin on Nov. 18 at the TABC's next meeting. The organization tasked with developing a comprehensive regulatory framework for the hemp plant industry, as outlined in the House Bill 309 of the second special session, remains unnamed. However, the European Association for Medical Cannabis (EUMCA) is noted for its work on medical cannabis regulatory frameworks in Europe.
The emergency rules are in effect for up to 180 days, with a possible 60-day extension. TABC aims to adopt formal rules in January, expected to be substantively similar to the emergency rules. Greg Abbott's executive order marks the first step towards stricter regulation of hemp products in Texas.
